Regulations for booking tickets and tickets online

I. Definitions

1. Museum/Module Operator – The Museum of Warsaw with its registered office in Warsaw at Rynek Starego Miasta 28 (00-272 Warsaw), with NIP (Tax Id. Number) 5251290392 and REGON (National Business Registry Number) 016387044. The Museum of Warsaw was entered in the Register of Cultural Institutions maintained by the City of Warsaw under RIK/8/2000/SPW on 04/07/2000, and the State Register of Museums maintained by the Minister of Culture and National Heritage under the number: PRM/66/2001, tel. (+48) 22 277 43 00 ; (+48) 22 277 44 02.
2. Module - a module of the Museum website designed to purchase tickets for events online at the following address: www.bilety.muzeumwarszawy.pl.
3. Museum ticket office – ticket offices located in individual branches of the Museum.
4. Event/Order - thematic walks, workshops, performances, occasional events, etc. and guided group tours or individual visits, organized by the Museum and taking place according to the dates indicated on the ticket and in accordance with the visiting regulations available on the website.
5. Regulations - these Regulations for the purchase of individual and group tickets online for Museum events via the Module and for the booking of group tickets by phone or e-mail, along with any changes.
6. Customer- a person purchasing individual and group tickets online and/or booking group tickets by phone or e-mail for Events organized by the Museum.
7. Ticket - a document entitling to use the event on a specified date, containing the fee for the Event in accordance with the data included in the ticket.
 
 II. General provisions

1. The Regulations specify detailed conditions for the purchase of individual and group tickets online and for the booking of group tickets for Events by phone or e-mail.
2. The Museum provides services of purchasing Individual and Group Tickets online and booking Group Tickets by phone or e-mail in accordance with the provisions of the Regulations.
3. When purchasing Tickets online and booking tickets by phone or e-mail, the Customer is obliged to read the Regulations, provide true information and not send any unlawful content.
4. Purchasing tickets online via the Module and booking tickets by phone or email does not incur any costs other than the cost of connecting to the Internet or the telephone operator at the expense of the Customer at the rates of the Internet provider or operator used by the Customer.
5. In the event that the Module is found to be defective, please contact us immediately by e-mail: bilety@muzeuwarszawy.pl.
6. In the event that the Customer uses the discount in the purchase price of Tickets or special Tickets, when checking Tickets at the Ticket offices he/she is obliged to present a document confirming the right to take advantage of the discount (i.e. student ID, school ID, pensioner ID, etc.). Tickets without a documented right to a discount do not entitle to enter the Event and are not refundable.
 
III. Booking Tickets via telephone or email

1. Telephone or e-mail bookings can be made in case of ordering:
- a screening in the Syrena Cinema (concerning only the Museum's Main Seat and only the film titled “Warszawa nie zapomni”)
- guiding service;
- museum lesson.
2. Telephone bookings can be made by calling the following numbers:
- the Museum's Main Seat – Education Department +48 665 645 603
- the Praga Museum of Warsaw – Education Department of PMW +48 22 518 34 07.
3. Email bookings can be made at:
- the Museum's Main Seat – edukacja@muzeumwarszawy.pl;
- the Praga Museum of Warsaw – edukacja.muzeumpragi@muzeumwarszawy.pl.
4. The booked Event must be paid at the Museum Ticket Offices no later than at the start of the Event, otherwise the booking will be automatically cancelled.
 
 IV. Purchase of individual and group tickets online

1. The purchase of individual and group tickets, with the exception of the Orders indicated in Article 3 para. 1 above, can be made online via the Module.
2. To purchase a Ticket via the Module, you must complete the purchase form and follow the instructions in the Module. The Museum shall ask you to fill in the form carefully and completely. Failure to follow the instructions in the Module may result in the inability to purchase the Ticket effectively. Providing incorrect data, in particular incorrect e-mail address, may result in the inability to receive a refund for unused Tickets in accordance with the provisions of Article 6 para. 3.
3. When purchasing Tickets online, payments are made by electronic transfer or credit card.
4. Ticket payments shall be handled exclusively by Dotpay Sp. z o.o. with its registered office in Kraków, ul. Wielicka 72, via the Internet portal: www.dotpay.pl.
5. Tickets remain the property of the Museum until the confirmation of payment made by the Customer’s bank is noted by the Museum.
6. Payments not confirmed by the Customer's bank within 60 minutes from the moment of placing the Order shall result in automatic cancellation of the Order, of which the Customer shall be informed in a separate e-mail message.
7. The lack of bank confirmation referred to in para. 5 above causes the money collected by the payment operator to be automatically returned to the Customer’s bank account. The Customer shall be informed about the manner of proceeding in such situation by e-mail by the payment operator - Dotpay Sp. z o.o., the owner of the portal: www.dotpay.pl, who shall be contacted directly via the contact form at www.dotpay.pl or by calling the following telephone number: +48 12 688 26 00.
8. Pursuant to the Regulation of the Minister of Finance of 26 July 2010 on exemptions from the obligation to keep records with the use of cash registers (Journal of Laws of 2010, No. 138, item 930), the sale of Tickets in the scope of Order and payment via the Internet is not subject to taxation, and therefore the Customer does not receive a fiscal receipt.
9. Ticket prices include VAT. In order to receive a VAT invoice, select the VAT invoice option during the ordering process and provide the correct data necessary to issue the invoice.
10. After the online purchase has been paid for and the payment has been booked in accordance with para. 5, the ticket shall be sent as a PDF attachment to the e-mail address provided by the Customer. Please verify immediately the correctness and conformity of the ticket with the Order, in particular the amount, type of Event, its date and time.
11. Ticket printed or saved on a mobile device, such as a smartphone, tablet or e-book reader, is subject to verification before entering the Event and constitutes a title to participate in the Event. In the case of a Ticket in electronic form, it should be remembered that the mobile device has to provide software correctly displaying PDF files.
12. The inability to purchase tickets via the online sales system does not mean that it is not possible to purchase tickets at the Museum Ticket Offices, provided that the tickets for the events are still available.

 V. Complaints

1. The Customer may file complaints regarding the process of purchasing tickets online and booking tickets by phone or e-mail and the quality of services provided by the Museum by sending an e-mail to the following address:  bilety@muzeumwarszawy.pl or by writing to the Museum to the address indicated in Article 1 para. 1, with the following annotation: Reklamacja- Biuro Rezerwacji, within 14 (fourteen) calendar days from the date of Ticket purchase.
2. In the complaint, the Customer shall indicate:
- the subject of the complaint;
- the Order number;
- the cause of filing the complaint.
3. The Museum shall not be liable for incorrectly made complaints, in particular for incorrect or untrue data provided by the Customer.
4. The Museum is also not liable for failure to deliver the message in case it is stopped by the Customer's anti-spam system.
5. The complaint shall be considered by the Museum within 14 calendar days from the date of its receipt by the Museum. The Museum shall inform the Customer in writing or by e-mail about the result of the complaint consideration to the address indicated in the complaint form, immediately after the complaint consideration is completed.
6. The complaint consideration by the Museum does not exclude the Customer’s right to pursue claims under the general rules of the Civil Code and the provisions of the Act on Consumer Rights of 30 May 2014 (Journal of Laws of 2014, item 827).

 VI. Return and exchange of tickets

1. In case the Event does not take place due to reasons for which the Museum is responsible, the Museum shall accept returns of Tickets purchased online and refund the paid amount.
2. Refunds for the reasons referred to in para. 1 for tickets paid at the Museum Ticket Offices may be made only at the Museum Ticket Offices.
3. The purchased Tickets cannot be returned or exchanged for Tickets at a different price or for another Event or another term of the Event, subject to the provisions of para. 1 of this Article.
4. Pursuant to Article 38(12) of the Act on Consumer Rights of 30 May 2014 (Journal of Laws of 2014, item 827), the right to rescind a distance contract shall not apply to services related to cultural events if the contract specifies a day or period of providing the service.
 

VII. Personal data protection

1. During the process of purchasing Tickets online and booking Tickets by phone or e-mail, the Customer shall provide the Museum with his/her personal data.
2. The administrator of Your personal data is the Museum of Warsaw with its registered office in Warsaw at Rynek Starego Miasta 42 (00-272 Warsaw), , NIP 5251290392, REGON 016387044. 3. The Customer’s personal data shall be processed in accordance with Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation - hereinafter referred to as the “GDPR") solely for the purposes related to the booking or purchase of Tickets.
4. The Recipient of the Customer’s personal data shall be entities authorized to process data based on the data processing agreement for the aforementioned purpose and the data may be transferred to entities authorized based on legal regulations.
5. The Customer’s personal data shall not be transferred to a third country/international organization.
6. The Customer’s personal data shall be stored for the period specified in the archiving regulations.
7. The Customer has the right of access to his/her data and the right to rectify it, as well as the right to lodge an objection.
8. The Customer has the right to lodge a complaint with a supervisory authority if he/she considers that the processing of his/her personal data violates the provisions of the General Data Protection Regulation or national regulations.
9. The Customer’s personal data shall not be processed in an automated way, including profiling. 

VIII. Final provisions

1. The Museum shall not be liable for the functioning of the Internet network through which Tickets are purchased. The Museum shall not be liable for messages or other data forfeited or lost in the Internet, individual computer settings and the  manner of the computer configuration, as well as settings or interruptions in the provision of services by Internet providers.
2. The Museum is not liable for Tickets damaged or lost by the Customer.
3. The regulations for purchasing tickets online and booking tickets by phone or e-mail are available on the website and at the Museum Ticket Office.
4. The Museum reserves the right to make changes and updates to the Regulations at any time, however any changes to the Regulations shall be communicated to the Customer by posting information about the changes in the Module and placing the changed Regulations in the Module and at the Museum's website.
